Background:

The property located at 1540 Keller Pkwy, Suite 108 has been a UPS Store since 2003. Because the Christmas holidays are the busiest time of the year, the UPS Store is requesting to place a 12-foot (length) by 8-foot (width) by 8-foot (height) temporary seasonal storage pod from November 1st to January 31st for the next three years (November 2022 - January 2025) to store additional packing supplies.

 

Site Design:

The Applicant proposes the temporary seasonal storage pod behind the store within two parking spaces, so the pod would have additional space on either side. (See Staff Attachment A.)                       

 

Parking:

Per the approved Planned Development from 1997, the Keller Crossing development relies on shared parking. (See Staff Attachment B - Keller Crossing PD development.) Consequently, parking will be sufficient.

 

Hours of Operation:

Monday through Friday 7:30 a.m. to 7:30 p.m.

Saturday 9 a.m. to 5 p.m.

Sunday 10 a.m. to 3 p.m.

 

SUP Request:

1.                     An SUP for a 12-foot (length) by 8-foot (width) by 8-foot (height) temporary seasonal storage pod from November 1st to January 31st for the next three years (November 2022 - January 2025) to store additional packing supplies.

 

Citizen Input:

On December 3, 2021, the City mailed out 22 Letters of Notification for this public hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was also posted on the site on December 3, 2021.

 

As of today, Staff has not received any responses from the public.

 

Planning and Zoning Commission Recommendation:

On December 14, 2021, the Planning and Zoning Commission spoke to the Applicant regarding the dates. Due to the short turn-around after the holidays for removal of the seasonal temporary storage pod, the Commission suggested modifying the removal date to the 31st of January in lieu of the 5th. The Applicant was amenable - and appreciated - the amendment. 

 

Summary:

Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the Planning and Zoning Commission and City Council shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

                     

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

                     

Alternatives:

The City Council has the following options when considering a Specific Use Permit:

 

§                     Approve as submitted.

§                     Approve with modified or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Deny.
