Background:

The Applicant submitted a Future Land Use Plan amendment earlier in 2024 for a slightly smaller area (48,699 square-feet compared to the current request for 55,959  square-feet) for a project that was exclusively residential. The original request was ultimately denied by City Council following a unanimous recommendation for approval by the Planning and Zoning Commission.

 

The Applicant is again requesting a Future Land Use Plan (FLUP) amendment to change the land use designation to Patio-Garden-Townhome from Retail/Commercial for a portion of the combined 6.43-acre property proposed as the Whitley Springs Planned Development. The development will have 22 single-family homes on lots of at least 5,000 square feet and two non-residential lots along U.S. Hwy. 377.

 

The PGT land use category requires 5,000 to 7,999 square foot lots for Patio and Garden Homes. Townhomes, duplexes, and fourplexes are permitted on lots smaller than 5,000 square feet under the PGT land use category.

 

Current FLUP Designation:                         

Retail/Commercial (RTC)

 

Proposed Land Use Designation: Patio-Garden-Townhome (PGT)

 

Current Zoning: Commercial

The Applicant is also requesting a zoning change from Commercial to Planned Development - Mixed Use, to include Patio Homes. That request is on the agenda as a separate item.

Citizen Input:

On October 31, 2024 the city mailed 36 letters of notification for this public hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was also posted on the site.

 

 

Alternatives:

The Planning and Zoning Commission has the following options when considering a future land use plan amendment application:

-                     Recommend approval as submitted.

-                     Table the agenda item to a specific date with clarification of intent and purpose.

-                     Recommend denial.
