Action Requested:                     

Consider a resolution approving Change Order No. 3 to the CMAR Services Agreement to re-establish the GMP for construction of additional amenities at the Keller Sports Park in the amount of $2,488,997.00; and authorizing the City Manager to execute all documents relating thereto on behalf of the City of Keller, Texas.

 

Background:                     

During the final construction phases of the Keller Sports Park Renovation Project, staff was instructed to obtain costs for several additional amenities, including a restroom facility near the Legacy Field, a monument sign near the Lacrosse Field, a screening wall for the material storage area, additional sidewalk connections, signage and vehicular bollards to be located throughout the park, improvements to the existing batting cages and Field 12, acoustical tiles for the Field House, and existing field light controls.   

On December 5, 2023, City Council approved Resolution No. 4739 authorizing Amendment No. 1 to the Construction Management At Risk (CMAR) Services Agreement for the Keller Sports Park Improvement Project with Dean Construction to manage the design cost and construction of the Keller Sports Park Improvements. 

On May 7th, 2024, City Council approved Resolution No. 4785 authorizing Change Order No. 1 to the CMAR Services Agreement to construct the Water Feature at the Keller Sports Park.

On June 18th, 2024, City Council approved Resolution No. 4798 authorizing Change Order No. 2 to the CMAR Services Agreement to reconstruct the remaining parking lots and streets in the Keller Sports Park.

Dean Construction negotiated pricing for the above additional amenities with their existing subcontractors for the Keller Sports Park Improvement Project which were selected through a competitive proposal package in accordance with the requirements of the Texas Government Code Chapter 2269, subchapter F. Each package represented a component of work necessary to construct the Project, including Civil Work, Site Work, Building Work, Mechanical Work, Electrical Work, and Field Improvements. The proposals providing the best value for each package were used to set the GMP for construction of the improvements to the Keller Sports Park by Dean Construction. The GMP was reviewed and negotiated by staff with the support of the architect of record.

Approval of Change Order No. 3 to the CMAR Services Agreement with Dean Construction in the amount of $2,488,997.00, will set the GMP for the entire Keller Sports Park Improvement Project in the amount of $43,090,440.73, and authorizes Dean Construction to construct the Project; and authorizes the City Manager to execute all documents relating thereto on behalf of the City of Keller, Texas.

 

Financial Impact:

Funding is included in the Fiscal Years 2023-24, 2024-25, and 2025-26 Parks Capital Improvement Funds, with funding provided by the Keller Development Corporation and the General Fund.

 

Citizen Input/Board Review:                     

Multiple public meetings and presentations on the project have been held since August 2021.

 

Legal Review:                       

The City Attorney has reviewed and approved the proposed resolution.
