Consider a request for a special exception to the City of Keller Unified Development Code, Article 9, Development Standards, Section 9.05 - Sign Regulations for Chalk & Steel Co., an indoor entertainment facility in an existing 7,310 square-foot lease space, on approximately 1.4 acres, located approximately 560 feet northeast of the intersection of Bourland Road and Keller Parkway, legally described as Block A, Lot 4RA, of the Shemwell Addition, zoned Retail, and addressed 761 Keller Parkway Unit 104. Background:
Chalk & Steel Co. recently had their SUP request approved on June 16, 2026 to operate an indoor entertainment facility at 761 Keller Parkway Unit 104.
The business is now requesting a special exception to UDC Section 9.05 - Attached Signs Wall Signs to allow for two attached signs with digitally printed vinyl graphics on the front elevation of the lease space.
Section 9.05 (D.6) Table 2 of the Unified Development Code (UDC) states that one attached sign per building elevation or lease space elevation visible from a public street or with a public entrance is permitted. The Applicant is requesting a special exception to allow for an additional attached sign on the front elevation.
Section 9.05 (D.4.c) of the UDC states that all permanent signs shall be constructed of quality materials including aluminum, masonry stone, brick, stucco, molded plastics and acrylic. The Applicant is requesting a special exception to allow for the signs to be composed of materials that are not listed in this section.
Sign Size and Material:
The Applicant proposes two signs on the front façade:
1) A 40.48 square-foot non-illuminated wall sign located above the entrance of the business; and
2) A 143.38 square-foot non-illuminated sign located above the lease space.
The maximum signage size allowed for this property is 200 square feet. Each sign falls within the allowable square footage for signage on this property.
Both signs are faced in black and white and include digitally printed vinyl graphics and an aluminum backer panel. The letters and boarders will be high-performance vinyl.
Special Exceptions Requested:
1. The Applicant is requesting a special exception to UDC Section 9.05 (D.6) Table 2 - Attached Signs Wall Signs to allow for two attached signs on the front elevation of the building.
2. The Applicant is requesting a special exception to UDC Section 9.05 (D.4.c) to allow for the use of sign materials that are not included in the list of approved materials specified by the UDC.
Summary:
Section 9.05 (B)(4)(a) of the UDC, lists criteria for approval of a special exception.
1. Whether the requested exception will not adversely affect public safety,
2. Whether the requested exception will not adversely affect surrounding properties,
3. Whether the requested exception will be in harmony with the spirit and purpose of this sign code,
4. Whether special conditions exist which are unique to the applicant or property,
5. Whether the requested exception demonstrates increased quality and standards, and
6. Whether the requested exception will be aesthetically appropriate in the area.
Citizen Input:
A UDC special exception does not require a public hearing. The public will have an opportunity to speak on this agenda item at the “Persons to Be Heard.”
Alternatives:
The Planning and Zoning Commission has the following options when considering a UDC special exception request:
• Recommend approval as submitted (with requested special exception).
• Recommend approval with modified or additional condition(s).
• Table the agenda item to a specific date with clarification of intent and purpose.
• Recommend denial.
City Council Action:
If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this UDC special exception application will be scheduled for City Council action on September 1, 2026.
