Action Requested:                     

Consider a resolution approving Change Order No. 1 to the CMAR Services Agreement to re-establish the GMP for construction of the splashpad at the Keller Sports Park in the amount of $4,886,208.00; and authorizing the City Manager to execute all documents relating thereto on behalf of the City of Keller, Texas.

 

Background:                     

During the Fiscal Year 2022-23 Keller Development Corporation Budget process, staff was directed to identify a location for the addition of a public splashpad. An RFQ for professional architectural and engineering services was issued and Parkill was the unanimous selection to help identify a location and design the splashpad. During the final design phases of the Keller Sports Park Renovation Project, the ideal location for the splashpad was determined to be at the Keller Sports Park.   

On December 5, 2023, City Council approved Resolution No. 4739 authorizing Amendment No. 1 to the Construction Management At Risk (CMAR) Services Agreement for the Keller Sports Park Improvement Project with Dean Construction to manage the design cost and construction of the Keller Sports Park Improvements. 

Dean Construction negotiated pricing for the splashpad with their existing subcontractors for the Keller Sports Park Renovation Project which were selected through a competitive proposal package in accordance with the requirements of the Texas Government Code Chapter 2269, subchapter F. Each package represented a component of work necessary to construct the Project, including Civil Work, Site Work, Building Work, Mechanical Work, Electrical Work, and Field Improvements. The proposals providing the best value for each package were used to set the GMP for construction of the improvements to the Keller Sports Park by Dean Construction. The GMP was reviewed and negotiated by staff with the support of the architect of record.

Approval of Change Order No. 1 to the CMAR Services Agreement with Dean Construction will set the GMP for construction of the splashpad in the amount of $4,886,208.00, and the GMP for the entire Keller Sports Park Improvement Project in the amount of $35,787,812.00, and authorizes Dean Construction to construct the Project; and authorizes the City Manager to execute all documents relating thereto on behalf of the City of Keller, Texas.

Along with the splashpad, the project consists of: a pumphouse with a family restroom; landscape enhancements; enhanced paving; furnishings; lighting; entry gateways; irrigation; sidewalks; shade structures; utility modifications; and grading/drainage improvements.

Financial Impact:

Funding is included in the Fiscal Year 2022-23 and 2023-24 Parks Capital Improvement Funds, with funding provided by Certificates of Obligation and annual payments will be funded by the Keller Development Corporation.

 

Citizen Input/Board Review:                     

Multiple public meetings and presentations on the project have been held since August 2021.

 

Legal Review:                       

The City Attorney has reviewed and approved the proposed resolution.
