Consider a resolution approving Amendment No. 1 to the Construction Manager at Risk (CMAR) Services Agreement with AUI Partners, LLC, of Fort Worth, Texas to Establish the Guaranteed Maximum Price (GMP) for Keller Police Department Renovation Project, and further authorizes the City Manager to execute said amendment relating thereto on behalf of the City of Keller, Texas.

Background:                     

In April 2022, the Crime Control & Prevention District (CCPD) Board approved the contract of $49,980, for professional architect services of Brinkley Sargent Wiginton Architects of Dallas to complete a Police Facility Renovation Study.

In October 2022, the Renovation Study was completed and provided a project budget of $4,259,000 with $3,191,000 being budgeted for construction. The project consisted of (1) expansion of existing staff parking, (2) 1,000 square foot addition, (3) 6,000 square feet of demolition and new construction within existing building and (4) 16,000 square feet of interior finish upgrades. The project includes work to be completed in the following areas: men and women locker rooms, new fitness facility, records, dispatch, criminal investigations, community room/EOC, break room, and refinishing in various areas throughout the facility.

On February 21, 2023, City Council approved Resolution No. 4625 approving the professional services agreement with Brinkley Sargent Wiginton Architect, Inc. of Dallas, Texas, to provide recommended basic services, design development, construction documents, bidding and construction administration services for the Keller Police Department ($556,735) and City Hall ($44,000) renovation project with a reimbursable budget ($10,765); in an amount not to exceed $611,500.00. Brinkley Sargent Wiginton Architects, Inc. was selected to provide these services based on their extensive previous work on the Keller Police Department Phase 1 and Phase 2 Capital Projects as well as the most recent police facility renovation study to prepare for this current project, in which the schematic design phase was completed of providing the design and construction documentation of the Keller Police Department.

On March 21, 2023, City Council approved Resolution No. 4635 authorizing a CMAR Services Agreement with AUI Partners, LLC, of Fort Worth, Texas as the Construction Manager at Risk (CMAR) for the Keller Police Department Renovation project.

Staff advertised for a Construction Manager at Risk (CMAR) as part of a two-step sealed Request for Qualifications (RFQ) process. Six (6) companies responded and AUI Partners, LLC was unanimously chosen as being the most qualified among the four (4) staff members assigned to the selection committee. As required by State bidding laws, once AUI Partners, LLC was selected, their fee proposal was opened. The fees total $273,354 for combined pre-construction and estimated general conditions.

AUI Partners, LLC advertised a competitive proposal package in accordance with the requirements of the Texas Government Code Chapter 2269, subchapter F. The proposals providing the best value for each package were used to set the GMP for construction of the Keller Police Department Renovation Project by AUI Partners, LLC. The GMP was reviewed, negotiated and value engineered by staff with the support of the architect of record.

Approval of Amendment No. 1 to the CMAR Services Agreement with AUI Partners, LLC will set the GMP for construction in the amount of $3,963,568 and authorizes AUI Partners, LLC to complete the Keller Police Department Renovation Project. Construction will begin in February 2024 and be substantially complete by December 2024.

 

Financial Impact:

Crime Control & Prevention District FY23-24 Budget was approved on June 21, 2023, by the CCPD Board and on July 18, 2023, by City Council including $4,500,000 for the Keller Police Department Renovation Project. After extensive value engineering, an additional $570,000 was approved on February 15, 2024, by the CCPD Board.

 

Citizen Input/Board Review:                     

Multiple CCPD Board meetings, public hearings and presentations on the project have been held since April 2022.

 

Legal Review:                       

The City Attorney has reviewed and approved the proposed resolution.
