Body

 

Background:

The Applicant requests a Specific Use Permit (SUP) for an 1,815 square-foot detached garage with an average height of 15 feet 8 inches.

 

The proposed structure is to be used as storage space for vehicles, equipment and household items.

 

There are two SUP triggers for the proposed structure:

1.                     An SUP to exceed 1,200 square feet in the SF-36 zoning district.

2.                     An SUP for the height of the structure to exceed an average of 15 feet tall.

 

Site Design:

The proposed site plan shows the structure is located behind the front facade of the main home and will conform to the setback requirements of the SF-36 zoning district. The proposed detached garage will replace the existing detached garage on the site.

 

Elevations:

The detached garage was designed with black metal panels and a single-slope roof.

 

The average height of the structure will be approximately 15 feet 8 inches; measured from the average of the base plate (14 feet 3 inches) and the peak (17 feet) of the roof. UDC Section 9.06 (A)(9) states that the maximum height of an accessory building shall not exceed fifteen feet (15') unless approved by a SUP for additional height.

 

Existing structures:

The main home is currently under construction and is approximately 5,998 square-feet. The UDC states that the combined area of all accessory buildings on a lot shall be less than 50% of the main structure, unless approved by an SUP.

 

There is an existing 1,500 square-foot detached building on the property that will be replaced with the proposed structure. The proposed structure is less than 50% of the square-footage of the main structure.

 

Request:

1.                     An SUP for the proposed accessory structure to exceed 1,200 square feet in the SF-36 zoning district.

2.                     An SUP for the height of the structure to exceed an average of 15 feet tall. The proposed average height is approximately 15 feet 8 inches.

 

Summary:

Section 8.02 (F)(2)(a) of the UDC states that when considering a SUP request, the Planning and Zoning Commission and City Council shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

 

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

 

Citizen Input:

On July 16, 2026, the City mailed 11 Letters of Notification for this public hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was also posted on the site.

 

Staff has received no public opinion letters in response to this request.

            

Planning and Zoning Commission Recommendation:

At the July 28, 2026, Planning and Zoning Commission meeting, Commissioners unanimously recommended approval of the SUP request as presented.

 

Alternatives:

The City Council has the following options when considering Specific Use Permit requests:

                     Approve as submitted.

                     Approve with modified or additional condition(s).

                     Table the agenda item to a specific date with clarification of intent and purpose.

                     Deny.
