Request:
The Applicant is requesting a 13-foot variance to the lot width standards of the SF-20 zoning district.
Why Action is Required:
Section 2.07(D) of the UDC, a variance or deviation may be granted by the City Council after a recommendation by the Planning and Zoning Commission (Commission) when special conditions exist that prevent the strict compliance of the Code.
Background:
The Applicant is requesting the lot width to be 107 feet in lieu of the required 120 feet in the SF-20 zoning district.
Zoning Requirements:
• Size of Lots
o 1) Minimum Lot Area - 20,000 square feet; proposed 34,360 square feet.
o 2) Minimum Lot Width - 120'; proposed 107’.
o 3) Minimum Lot Depth - 150'; proposed 321.12’.
• Setbacks
o 1) Minimum Front Yard - Thirty-five feet (35')
o 2) Minimum Side Yard - Ten percent (10%) of the lot width but no more than fifteen feet (15')
o 3) Minimum Rear Yard - Twenty feet (20') adjacent to an alley; fifteen feet (15') if no alley.
The lot meets all setback requirements.
Citizen Input:
On July 16, 2021, the City mailed out 20 Letters of Notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site on July 16, 2021. The notice for the City Council public hearing was published in the August 1, 2021, edition of the Fort Worth Star-Telegram.
As of today, Staff has not received any comments either in support or opposition from the public although three people spoke during the Commission Public Hearing. (See below).
Planning and Zoning Recommendation:
On July 27, 2021, the Planning and Zoning Commission held a public hearing and unanimously recommended approval for the variance for the lot width. The Commission noted by replatting the two lots into one, the lot met all but one of the zoning requirements for the base zoning district (SF-20). By supporting the request, the lot could be closer to full compliance with the zoning regulations. The applicant was present. Three people spoke in opposition citing uncertainty of potential development of the lot, in particular the size of the home that could be built, and requested additional information for future projects. Staff provided that information after the meeting.
Summary:
Section 2.07 (A) (2) of the UDC states the Planning and Zoning Commission and City Council shall take into account the nature of the proposed use of land involved and existing uses of the land in the vicinity, the number of persons who will reside or work in the proposed subdivision, and the probable effect of such variance upon traffic conditions and upon the public health, safety, convenience, and welfare in the vicinity. No variance shall be granted unless the Planning and Zoning Commission and City Council finds:
1) That there are special circumstances or conditions affecting the land involved such that the strict application of the provisions of this Code would deprive the applicant of the reasonable use of his land.
2) That the granting of the variance will not be detrimental to the public health, safety or welfare, or injurious to other properties in the area.
3) That the granting of the variance will not have the effect of preventing the orderly subdivision of other lands in the area in accordance with the provisions of this Code.
4) That the granting of the variance will not constitute a violation of any other valid ordinance of the City of Keller.
5) That strict compliance with the regulations, and/or that the purpose of the regulations will be served to a greater extent by the alternative proposal.
Alternatives:
The City Council has the following options when considering a variance:
§ Approve as recommended by the Planning and Zoning Commission.
§ Table the agenda item to a specific date with clarification of intent and purpose.
§ Deny.
