Background:

Staff is proposing to modify Section 5.17of the Unified Development Code (UDC) which addresses drainage easements. Staff is proposing to eliminate the requirement to dedicate floodplain to the City in a separate lot. In addition, Staff is proposing to clarify drainage easement requirements and maintenance responsibilities. (See the Staff Attachment for the mark-up version of the proposed amendments.)

 

Citizen Input:

An amendment to the text of the UDC requires a public hearing notice to be published in the local newspaper 15 days prior to the scheduled City Council meeting date. The notice for the City Council public hearing was published in the April 1, 2021, edition of the Fort Worth Star-Telegram. 

 

As of today, Staff has not received any comments either in support or opposition from the public.

 

The Planning and Zoning Commission Recommendation:

On March 23, 2021, the Planning and Zoning Commission unanimously recommended to approve the item as submitted.

 

Alternatives:

The City Council has the following options when considering an amendment to the text of the UDC:

 

-                     Approve as submitted.

-                     Approve with modifications or additional amendments(s).

-                     Table the agenda item to a specific date with clarification of intent and purpose.

-                     Deny.
