Consider a resolution approving a professional services agreement with Freese and Nichols, of Fort Worth, Texas for the Lead and Copper Rule Revision Compliance Program Phase 2 Services project, for the Public Works Department; and authorizing the City Manager to execute all documents relating thereto on behalf of the City of Keller, Texas.
Action Requested:
Approve a resolution authorizing a professional services agreement with Freese and Nichols, of Fort Worth, Texas for the Lead and Copper Rule Revision Compliance Program Phase 2 Services project in the amount of $224,598.00.
Background:
In 2020, the City received a letter from the Texas Commission on Environmental Quality (TCEQ) advising that additional Lead and Copper sampling would soon be required. In addition to the requirements from TCEQ, the Environmental Protection Agency (EPA) published rules in January 2021 requiring water testing in schools and childcare centers, in addition to the provisioning of a Lead Service Line (LSL) system inventory, and the development of a public facing inventory. The City of Keller is required to comply with the federally mandated EPA Lead and Copper Rule Revisions (LCRR) requirements by October 16, 2024.
Utilizing experience gained over successive uitility projects, City staff has worked with Freese and Nichols to develop a professional services scope to address all required compliance items by the required deadline.
Financial Impact:
Funding for this item is included with the Water & Wastewater Administration operating budget with funding provided by the Water & Wastewater Utility Fund.

The City Attorney has been reviewed and approved this item.

Staff recommends approval of the proposed resolution as presented.
