PUBLIC HEARING: Consider a request for a Specific Use Permit (SUP), for a 1,276 square-foot accessory structure, on 1.12 acres, located on the west side of North Pearson, approximately 2200 feet northwest from the intersection of Keller Parkway and North Pearson Lane, legally described as Lot 1, Block A of the Gary Cromwell Addition, zoned Single-Family 36,000 square-foot lot size or greater (SF-36) and addressed 516 N Pearson Lane. Body
Background:
The applicant is requesting an SUP to construct a 1,276 square foot accessory structure for the purpose of boat storage and fitness space. In the SF-36 zoning district, an SUP is required for accessory structures that exceed 1,200 square feet in total size.
There are two SUP triggers for the proposed structure:
1. An SUP to exceed 1,200 square feet in the SF-36 zoning district.
2. An SUP for the height of the structure to exceed an average of 15 feet tall.
Structure Location:
The concept plan submitted by the Applicant indicates that the structure will be located behind the main residence.
The Applicant intends to meet all other UDC guidelines and setbacks for the SF-36 zoning district.
Elevations:
A building permit was issued in October of 2025 for a primary residence on the property. The main home is currently under construction. The requested structure will consist of metal roofing, hardie board and batten siding, and other finishes to match the primary residence.
Existing Structures:
The main home is approximately 6,400 square-feet. The UDC states that the combined area of all accessory buildings on a lot shall be less than 50% of the main structure, unless approved by an SUP. There are no other accessory structures on the lot. The square-footage of the proposed structure is less than 50% of the square-footage of the main structure.
Surrounding Land Use Designations:
North: Low-Density Single Family (LD-SF)
East: Southlake
South: Low-Density Single Family (LD-SF)
West: Low-Density Single Family (LD-SF)
SUP Requests:
1. An SUP for a 1,276 detached garage to exceed 1,200 square feet in the SF-36 zoning district.
2. An SUP for the height of the structure to exceed an average of 15 feet tall. The proposed average height is 16 feet and 7 inches.
Summary:
Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the Planning and Zoning Commission and City Council shall consider the following factors:
1) The use is harmonious and compatible with surrounding existing uses or proposed uses;
2) The activities requested by the applicant are normally associated with the permitted uses in the base district;
3) The nature of the use is reasonable and appropriate in the immediate area;
4) Any negative impact on the surrounding area has been mitigated; and
5) That any additional conditions specified ensure that the intent of the district purposes are being upheld.
Citizen Input:
On January 15, 2026, the City mailed out 11 letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site.
Staff has received no letters of support or opposition in response to this SUP request.
Alternatives:
The Planning and Zoning Commission has the following options when considering a Specific Use Permit:
§ Recommend approval as submitted.
§ Recommend approval with modified or additional condition(s).
§ Table the agenda item to a specific date with clarification of intent and purpose.
§ Recommend denial.
City Council Action:
If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this Specific Use Permit application will be scheduled for City Council action on February 17, 2026.
