Background:

City Council recently approved a Façade Improvement Grant for Swanky Chic Boutique for multiple exterior improvements, including the installation of a mural. The subject property is located within the Main Street Subdistrict of the Old Town Keller Zoning District, where property owners have the opportunity to pursue a mural application.

 

Section 9.05 of the Unified Development Code (UDC) states that the following guidelines apply in zoning districts where murals may be considered:

 

a.                     Private murals are permitted in the Katy Road, Retail, OTK and Town Center Zoning Districts with approval from City Council following a recommendation by the Planning and Zoning Commission. Where permitted, the following applies: 

 

1)                     Shall not include any owner identification or commercial text message; however, it may contain graphics or images that relates to the products or services offered on the premises where the mural is located.

 

2)                     Murals or art representation displaying any owner identification or commercial text message will be considered as a "flat/wall sign". 

 

3)                     Shall not depict nudity or obscene images and be generally acceptable for viewing by all audiences.

 

4)                     Materials utilized in painting a mural shall have proven durability and shall be maintained or removed if not maintained.

 

The proposed mural will be installed on the storage building on the property, located east of the primary retail structure. The storage building is approximately 400 square feet, and the mural depicting a dandelion will be painted on the north and west elevations. Total mural size is approximately 156 square feet.

 

The mural artist is Victoria Zietsman, who anticipates the project will take about three weeks. A rendering of the proposed mural is attached in Exhibit “A”.

 

Citizen Input:

A Mural application does not require a public hearing, so no public hearing notifications were sent out to the surrounding property owners for this request. The public will have an opportunity to speak on this agenda item at the “Persons To Be Heard”.                     

 

Planning and Zoning Commission Recommendation:

At the January 23, 2024, Planning and Zoning Commission meeting, Commissioners unanimously recommended approval of the mural as presented.                      

 

Alternatives:

The City Council has the following options when considering a Mural application request:

 

§                     Approve as submitted.

§                     Approve with modified or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Deny.
