Background:

The UPS Store, located at 1540 Keller Parkway, Suite 108, was previously approved for a Specific Use Permit (SUP-21-0040) to allow a temporary seasonal storage container for supplies during the store’s busiest time of year. The original SUP, approved in 2022, permitted the storage container to be placed on-site for a three-month period each year for a period of three years.

 

The previously approved SUP has expired, and the applicant is requesting approval of a new SUP to continue the temporary seasonal storage use. The current request proposes to allow the temporary storage container annually from November 15 through January 15, for a three-year period.

 

Section 9.06 (A.13) states that extended use of storage containers may be considered with an SUP.

 

Site Design:

The Applicant proposes the temporary seasonal storage container to be located in the parking area behind The UPS Store and has stated that the container will not be visible to the general public accessing store fronts in the shopping center. The applicant packet includes aerial imagery indicating the proposed location of the storage container.

 

The container will be 12 feet (length) by 8 feet (width) by 8 feet (height).

 

SUP request:

1.                     An SUP for a 12-foot (length) by 8-foot (width) by 8-foot (height) temporary seasonal storage container from November 15 to January 15 for a three (3) year period.

 

Surrounding Zoning and Land Use:

North: Retail-PD-1685/ RTC

East: Retail-PD-1685/ RTC

South: SF-8.4 / HD-SF

West: Retail-PD-870/ RTC

 

The subject property is zoned Retail-PD-1382 and designated Retail/Commercial (RTC) on the city’s Future Land Use Plan (FLUP).

 

Summary:

Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the Planning and Zoning Commission shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

                     

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

                     

 

Citizen Input:

On October 1, 2026, the City mailed out 34 letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site.

 

Staff has received no letters of support or opposition in response to this SUP request.

 

Alternatives:

The Planning and Zoning Commission has the following options when considering a Specific Use Permit:

 

•                     Recommend approval as submitted.

•                     Recommend approval with modified or additional condition(s).

•                     Table the agenda item to a specific date with clarification of intent and purpose.

•                     Recommend denial.

                     

City Council Action:

If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this Specific Use Permit application will be scheduled for City Council action on November 3, 2026.
