Background:
The Applicant has withdrawn this request from consideration.
Hillside Assisted Living is an assisted living facility that has been operating at 553 Big Bend Drive since 2018. The facility is currently permitted to house up to six residents. The Applicant is now requesting an SUP to allow the facility to continue operating with two additional residents for a total of eight residents.
In 2016, the City Council approved an amendment to the UDC to include Assisted Living Facilities with up to six residents as a permitted use in all single-family zoning districts, in accordance with state regulations. The amendment also established that facilities with seven or eight residents may be allowed in those zoning districts with approval of an SUP.
Site Design:
The 3,733 square-foot home has six bedrooms and four bathrooms, located on an approximately 0.3 acre lot.
Hours of Operation:
Visiting hours are from 9:00 AM to 5:00 PM daily, with some exceptions made depending on the situation of the resident.
Employees:
The facility currently has nine total employees, not including the owners. The Applicant has stated that they are actively seeking to hire at least three additional employees. The facility has a maximum of three employees working at a time, not including new employees in training.
Citizen Input:
On June 26, 2025, the City mailed out 31 letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site. A public hearing notice sign was posted on the site.
Staff has received six letters of opposition in response to this SUP request.
Opposition within the 200’ buffer is at 25.9% so a supermajority (6 out of 7) vote is required for approval of the SUP.
Planning and Zoning Commission Recommendation:
At the July 8, 2025, Planning and Zoning Commission meeting, Commissioners unanimously recommended denial of the SUP request as presented.
Request:
A Specific Use Permit to continue operating with two (2) additional residents up to a total of eight (8) residents in the SF-12-PD-769 zoning district
Summary:
Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the Planning and Zoning Commission and City Council shall consider the following factors:
1) The use is harmonious and compatible with surrounding existing uses or proposed uses;
2) The activities requested by the applicant are normally associated with the permitted uses in the base district;
3) The nature of the use is reasonable and appropriate in the immediate area;
4) Any negative impact on the surrounding area has been mitigated; and
5) That any additional conditions specified ensure that the intent of the district purposes are being upheld.
Alternatives:
The City Council has the following options when considering a Specific Use Permit:
§ Approve as submitted.
§ Approve with modified or additional condition(s).
§ Table the agenda item to a specific date with clarification of intent and purpose.
§ Deny.
