Title

PUBLIC HEARING: Consider an ordinance approving amendments to the City of Keller Unified Development Code (UDC), adopted by Ordinance No. 1746 dated July 7, 2015, by amending Article 5 - Subdivision Design; authorizing publication; provide for penalties; and establishing an effective date. City of Keller, applicant. (UDC-21-0004)

Body

Background:

Staff is proposing to amend Article 5 of the Unified Development Code (UDC) to change standards regarding existing Fire Lane pavement regulations. The proposed amendment to the UDC allows applicants to have the option to core sample existing pavement to test it for potential use as fire lane pavement. If the test results (confirmed by a licensed Texas engineer) meet the current standards for fire lanes as set forth by the UDC, the existing pavement may be used rather than installing a new fire lane.

Citizen Input:

An amendment to the text of the UDC requires a public hearing notice to be published in the local newspaper fifteen (15) days prior to the scheduled City Council meeting date. The notice for the City Council public hearing was published in the April 30, 2021, edition of the Fort Worth Star-Telegram.

Planning and Zoning Commission Recommendation:

On April 27, 2021, the Planning and Zoning Commission held a public hearing at which no one spoke in favor or opposition; the Commission voted unanimously to approve the item as presented.

City Council Action:

The City Council has the following options when considering an Amendment to the Unified Development Code:

Approve as recommended by the Planning and Zoning Commission.

Approve with modified or additional condition(s).

Table the agenda item to a specific date with clarification of intent and purpose.

Deny.
