Consider an ordinance amending the City of Keller Code of Ordinances by amending Chapter 7, Citywide Solid Waste Collection and Recycling Services, by deleting Chapter 7, Citywide Solid Waste Collection and Recycling Services in its entirety, and adding a new Chapter 7, Citywide Solid Waste Collection and Recycling Services; providing a severability clause; providing a penalty; authorizing publication; and establishing an effective date.
Action Requested:
City Council consideration of an ordinance amending the City of Keller Code of Ordinances by amending Chapter 7, Citywide Solid Waste Collection and Recycling Services.
Background:
This ordinance is being presented in conjunction with a new five (5) year agreement with Community Waste Disposal for City Council consideration. In order to avoid conflicts between the new proposed agreement and the existing City ordinances, changes must be made to Chapter 7 of the City Code, Citywide Solid Waste Collection and Recycling Services.
The proposed ordinance deletes Chapter 7 in its entirety and adds a new Chapter 7 that incorporates the franchise agreement by reference. The new chapter keeps provisions needed for sanitation, public health, and code compliance, while moving contract-specific requirements into the franchise agreement.
The proposed ordinance incorporates the following substantive changes:
1. Incorporates the citywide solid waste collection and recycling services franchise agreement by reference
2. Retains customer requirements related to collection set-out times, container placement, acceptable brush, yard waste, recyclable materials, and unacceptable waste
3. Retains provisions related to Household Hazardous Waste (HHW) and Electronics Waste (E-Waste) collection
4. Retains commercial container, enclosure, spillage, unsafe access, and animal-related provisions used for code compliance
5. Removes duplicative contract provisions related to rates, franchise fees, reporting, customer service requirements, non-performance charges, insurance, bonds, and termination, which are addressed in the proposed franchise agreement
Financial Impact:
There is no direct financial impact associated with this ordinance. Rates, billing, and franchise fees are addressed in the companion franchise agreement.
Citizen Input/Board Review:
A committee composed of Council Members and staff reviewed the companion solid waste franchise agreement and related service considerations. No separate citizen input or board review was required for this ordinance.
