Body

 

Background:

The Applicant requests a Specific Use Permit (SUP) to construct an outdoor recreation building in excess of the 1,000 square-feet permitted in the SF-20 zoning district. The accessory structure will also be used for storage, including lawn equipment.

 

The Applicant requests to construct an outdoor shower area and one indoor bathroom. He intends for the main area of the structure to serve as a game room and gathering area with a refrigerator, microwave, sink, and counter space/eating bar.

 

Site Design:

The Applicant has provided building plans and elevations, drainage plans, and an engineered foundation letter. The accessory structure will be constructed using similar brick, trim, shingles, and paint as the existing home.

 

The structure will be in the southwest corner of the property and meet all setback requirements of the SF-20 zoning district, respecting the 20’ utility easement on the west side of the property and 15’ side yard on the south side of the property.

 

A 120 square-foot shed will be removed from the property during construction. There are no other accessory structures on site.                                          

 

Elevations:

The structure will be visible to Mount Gilead Road, a neighbor to the West, and a neighbor to the South. A neighbor across the street may be able to see the structure’s roofline. The Applicant has met with the three neighbors, shared the proposed plans, and states they do not have any objection to the proposed project.

 

Summary:

Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the Planning and Zoning Commission shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

                     

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

                     

Citizen Input:

On January 12, 2023, the City mailed out 15 letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site. As of January 17, 2023, staff has not received any opposition or support letters to the proposed SUP. 

 

Alternatives:

The Planning and Zoning Commission has the following options when considering a Specific Use Permit:

 

§                     Recommend approval as submitted.

§                     Recommend approval with modified or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Recommend denial.

                     

City Council Action:

If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this Specific Use Permit application will be scheduled for City Council action on February 21, 2023.
