Body

 

Background:

§                     The applicant is proposing to build a 4,000 square-foot medical office building along with a 16,722 square-foot office building on this property.

 

Tree Replacement Regulations:

According to Section 8.19 (C) (3) (d), “All trees within street rights-of-way, utility or drainage easements, building pads, driveways, and fire lanes as shown on an approved site plan may be removed and shall be exempt from the tree protection and replacement requirements specified herein.   An additional twenty percent (20%) of the remaining quality trees may be removed without penalty for parking lots and/or for grading and drainage purposes. Any additional tree removal in excess of twenty percent (20%) shall be subject to the tree replacement and mitigation requirements as defined herein.” 

 

Tree Mitigation Plan:

According to the requirements above, the Applicant must mitigate for 171 caliper inches. They are proposing to plant 74 caliper-inches on-site per UDC requirements and then pay $14,550 into the Tree Reforestation Fund for the remaining 97 caliper inches ($150/caliper inch).

 

Citizen Input:

An appeal to the Tree Ordinance does not require a public hearing, so no public hearing notifications were sent out to the surrounding property owners for this request. The public will have an opportunity to speak on this agenda item during the “Persons To Be Heard”.

 

Alternatives:

The Planning and Zoning Commission has the following options when considering an Appeal to the Tree Preservation application:

§                     Recommend approval as submitted.

§                     Recommend approval with modifications or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Recommend denial.

                     

City Council Action:

If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then City Council may take action on 4/14/2020 and will have the following options when considering a Tree Preservation Appeal application:

§                     Approve as submitted.

§                     Approve with modifications or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Deny.
