Action Requested:                     

Approve a resolution terminating the contract approved by Resolution No. 4649 on May 2, 2023 with Apple Pavement Services, of Dallas, Texas, and authorizing the City Manager to provide the seven (7) day written notice per sections 15.02.A.1 and 15.02.B of the contract documents.

 

Background:                     

On April 5, 2023 eight (8) sealed bids were received for the Shady Grove Road Improvements project. Staff, with the assistance of an engineering consultant, reviewed the bids and references and recommended Apple Pavement Services of Dallas, Texas be awarded the contract. City Council approved the resolution on May 2, 2023.

The contractor has substantially completed the hike and bike trail extension and ~1600 linear feet of ~3600 linear feet of roadway reconstruction included in this project. The portion completed had many challenges related to the construction requirements and lack of communication on project changes. Several meetings were held to clarify the requirements, however the roadway continued to be constructed in manner inconsistent with the documents. This continuation left staff with no choice but to recommend termination of the remaining portion of the contract. The portion not completed includes the intersection of Shady Grove and Keller-Smithfield and west to Rapp Road. It is anticipated this portion will be repackaged and bid as a standalone project.
