Action Requested:                     

Approve a construction contract with N.G. Painting, L.P. of Kerrville, Texas for the Rehabilitation of the Pearson Ground Storage Tank #1 project in the amount of $1,920,081.00.

Background:                     

In the fall of 2022, a construction contract for this project was approved.  After the contract was executed, but prior to starting construction, that contractor failed to meet strict contractual obligations and the contract was terminated.  Due to the limited time the tank can be taken out of service for rehabilitation work, staff recommended terminating the contract which was approved by Resolution No. 4616.

The project was re-bid and on June 22, 2023 three (3) bids were received.  Staff, with the assistance of an engineering consultant, reviewed the bids and references and recommends N.G. Painting, L.P. of Kerrville, Texas be awarded the contract in the amount of $1,920,081.00, including bid alternate #1 with construction to be substantially complete within 200 calendar days of notice to proceed.  A bid summary is included.

N.G. Painting is the second low bidder.  The low bidder did not provide adequate subcontractor reference information and is considered non-responsive.  Due to the tight construction schedule, the sub-contractors are critical to the successful delivery of this project.  Staff is taking every pre-caution to ensure the tank is back in service in time for the increased water demand.

Financial Impact:

Funding for this activity is included in the Water & Wastewater Capital Improvements Project Fund with funding provided by the Water & Wastewater Utility Fund and ARPA funds.

The City Attorney has been reviewed and approved this item.

Staff recommends approval of the proposed resolution as presented.
