PUBLIC HEARING: Consider a request for a Specific Use Permit (SUP) for an approximately 2,259 square-foot detached accessory building, located on 2.46 acres, on the west side of Keller Smithfield Road S., approximately 3,065 feet northwest of the intersection of Shady Grove Road and Keller Smithfield Road S., legally described as Lot 1, Block 1 of the Phabke Hill subdivision, zoned Single-Family 36,000 square-foot lot size or greater (SF-36) and addressed 912 Keller Smithfield Road S. Chase Hall, Applicant. Jerry and Jill Pham, Owner. (SUP-2605-0016)
Background:
The Applicant requests a Specific Use Permit (SUP) for a 2,259 square-foot detached accessory building with an average height of 18 feet.
The proposed structure is to be used as residential storage, workshop, garage, and recreational space.
There are two SUP triggers for the proposed structure:
1. An SUP to exceed 1,200 square feet in the SF-36 zoning district.
2. An SUP for the height of the structure to exceed an average of 15 feet tall.
Site Design:
The proposed site plan shows the structure is located behind the existing home and will conform to the setback requirements of the SF-36 zoning district.
The structure is proposed to be located approximately 415 feet from the front, 15 feet from the south side property line, and 170 feet from the rear property line.
Access to the proposed structure will be provided by the existing driveway.
Elevations:
The detached garage was designed to match the materials of the main home on the property and is constructed of metal walls and roof with stone accents.
UDC Section 9.06 (A)(9) states that the maximum height of an accessory building shall not exceed fifteen feet (15') unless approved by a SUP for additional height.
Existing structures:
The main home is approximately 4,859 square-feet. The UDC states that the combined area of all accessory buildings on a lot shall be less than 50% of the main structure, unless approved by an SUP. There are no other accessory structures on the lot. The proposed structure is less than 50% of the square-footage of the main structure.
Request:
1. An SUP for the proposed accessory structure to exceed 1,200 square feet in the SF-36 zoning district.
2. An SUP for the height of the structure to exceed an average of 15 feet tall. The proposed average height is approximately 18 feet.
Summary:
Section 8.02 (F)(2)(a) of the UDC states that when considering a SUP request, the Planning and Zoning Commission and City Council shall consider the following factors:
1) The use is harmonious and compatible with surrounding existing uses or proposed uses;
2) The activities requested by the applicant are normally associated with the permitted uses in the base district;
3) The nature of the use is reasonable and appropriate in the immediate area;
4) Any negative impact on the surrounding area has been mitigated; and
5) That any additional conditions specified ensure that the intent of the district purposes are being upheld.
Citizen Input:
On June 30, 2026, the City mailed 25 Letters of Notification for this public hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was also posted on the site.
Staff has received no public opinion letters in response to this request.
Alternatives:
The Planning and Zoning Commission has the following options when considering Specific Use Permit requests:
• Recommend approval as submitted.
• Recommend approval with modified or additional condition(s).
• Table the agenda item to a specific date with clarification of intent and purpose.
• Recommend denial.
City Council Action:
If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, this Specific Use Permit application will be scheduled for City Council action on August 4, 2026.
