Background:

 

Section 3.01 (142) of the UDC defines indoor entertainment facility as “Any building, room, place or establishment of any nature or kind and by whatever name called, where amusement devices are operated for a profit, whether the same be operated in conjunction with any other business or not, including but not limited to such amusement devices as bowling, skating, laser tag, miniature golf, musical devices, coin operated pinball machines, video games, electronic games, shuffle boards, pool tables or other similar amusement devices.”

 

It was brought to the attention of city staff that the existing restaurant was operating with pool tables, and the applicant was notified of the SUP requirement to operate as an indoor entertainment facility.

 

The Keller Police Department is researching the use of the gaming machines. Even if the Applicant is required to remove those devices, an SUP is still required for the pool tables.

 

Business Details:

The business will continue operating as a restaurant. No expansion of the building or change to the primary use of the property is proposed as part of this request. The requested SUP is solely to authorize the indoor entertainment facility use associated with these amusement devices.

 

Site Design:

The facility will continue operating in the existing lease space. The application packet includes photos of the restaurant interior.

 

Land Use:

North: Mixed Use (MU)

East: Retail/Commercial (RTC)

South: Mixed Use (MU) and Retail/Commercial (RTC)

West: Semi-Public (SP)

 

The subject property is zoned Retail (R) and designated Mixed Use (MU) on the city’s Future Land Use Plan (FLUP).

 

Citizen Input:

On July 30, 2026, the City mailed out 25 letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site.

 

Staff has received no public feedback in response to this SUP request.

 

Request:

An SUP to operate an indoor entertainment facility for Eagle Tavern in the Retail (R) zoning district. 

 

Summary:

Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the Planning and Zoning Commission shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

                     

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

 

 

Alternatives:

The Planning and Zoning Commission has the following options when considering a Specific Use Permit:

§                     Recommend approval as submitted.

§                     Recommend approval with modified or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Recommend denial.

 

City Council Action:

If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this Specific Use Permit application will be scheduled for City Council action on September 1, 2026.
