Background:

Home Occupations Definition

 

Medical Spa Definition

In 2024, City Council approved several amendments to the Town Center Zoning District Use Chart, along with changes to other parts of the UDC related to spas and a new Medical Spa definition. When the Planning and Zoning Commission considered a Medical Spa Specific Use Permit under the new definition, they identified an issue with the phrase “non-invasive” in the definition, even though many of the proposed services would include injections. The phrase “minimally invasive” was recommended by one of the Commissioners who is also a physician, along with language that states Medical Spas must follow regulations of the Texas Medical Board.

 

Home Occupations Definition

In April and June 2026, staff held work session discussions with the City Council regarding resident concerns submitted to Code Compliance about commercial activities in residential neighborhoods. The only UDC section that addresses this type of issue is in the Home Occupations definition, which staff worked with Council to reorganize and add a few factors staff can use when evaluating a home occupation complaint.

 

Proposed Amendments:

See Exhibit “A” (pages 15 and 20).

 

Summary:

The proposed UDC Amendments include:

1.                     Modified Medical Spa definition that replaces “non-invasive” with “minimally invasive” to describe the types procedures allowed and language requiring Medical Spas to follow the regulations of the Texas Medical Board.

2.                     Modified Home Occupation definition that provides an updated, bulleted list of factors to be used by staff to evaluate a home occupation complaint, including a guideline that states “the existence of the occupation or activity shall be carried out by inhabitants of the dwelling on premises.”

Citizen Input:

An amendment to the text of the UDC requires a public hearing notice to be published in the local newspaper ten (10) days prior to the scheduled Planning and Zoning Commission meeting date and fifteen (15) days prior to the City Council Meeting Date. The notice for the Planning and Zoning Commission public hearing was published in the July 2, 2026, edition of the Fort Worth Star-Telegram.  Staff has not received any comments from the public on the proposed UDC Amendments.

 

Alternatives:

Planning and Zoning Commission has the following options when considering an amendment to the text of the UDC:

                     Recommend approval as submitted

                     Recommend approval with modifications or additional amendments(s)

                     Table the agenda item to a specific date with clarification of intent and purpose

                     Recommend denial

                     

City Council Action:

If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this UDC Text Amendment application will be scheduled for City Council action on August 4, 2026.
