PUBLIC HEARING: Consider a request for a Zoning Change from Old Town Keller (OTK) to Retail (R), approximately 96.067 acres, generally located north of Keller Parkway, south of Johnson Road, east of the railroad, and west of Elm and Charles Streets; including the properties on the attached list. City of Keller, Applicant. (Z-22-0003)
Background:
September 2002: The Old Town Keller (OTK) overlay was established with a base zoning district of Commercial.
July 2015: The OTK overlay was converted into straight zoning district (OTK) eliminating the base districts throughout the new OTK zoning district. (See the attached OTK District use chart and design standards and the Retail use chart and design standards.)
July 2022: City Council approved a zoning change from OTK to Retail for properties south of the actual Bear Creek and Bear Creek Parkway - a medical district with a hospital, medical offices, and restaurants rather than an area geared toward the pedestrian-oriented uses called out for in the OTK District (a mix including entertainment and residential uses).
In recent months, the City Council, Planning and Zoning Commission and Staff have discussed the potential development of the North Main Overlay District (NMOD). As part of that discussion, Staff suggested changing the base district for the properties between Keller Parkway and Johnson Road -from Old Town Keller to Retail -. The area is tightly developed and car-centric, making it difficult for businesses to conform to the OTK design guidelines. While City Council has not yet decided to move forward with the NMOD, they did request staff bring forward this proposed zoning change to allow some relief for existing and future businesses in this section of OTK.

On October 13, 2022 the City mailed out 123 Letters of Notification for this public hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was also posted on the site.
As of today, there has been no response in favor or opposition to this proposed zoning change.
Alternatives:
The Planning and Zoning Commission has the following options when considering a zoning change request:
- Recommend approval as submitted.
- Recommend approval with modified or additional condition(s).
- Table the agenda item to a specific date with clarification of intent and purpose.
- Recommend denial.
