Body
Background:
In May 2023, the Applicant applied for a permit to finish out Suite 107 at 101 Town Center Lane (previously occupied by Painting with a Twist, which relocated to a different space on the same street in 2022). The permit was denied because at the time the Unified Development Code (UDC) had no guidelines for medical spas, and medical uses were not allowed, even by Specific Use Permit (SUP) in the Town Center zoning district.
The Applicant and property owner (Regency) urged the city to pursue UDC amendments that would create a pathway for Medical Spas to be considered by City Council, something staff had already begun exploring based on feedback from other potential applicants.
City Council approved several UDC amendments on March 5, 2024, including changes to the Town Center use chart that allow Medical Spas by SUP.
Site Design:
The Applicant intends to modify the interior of the approximately 2,500 square-foot space to accommodate three treatment rooms, an I.V. room, consultation office and injector office, along with a lab area, employee break room, lobby and foyer. Other improvements will include new flooring, paint, hardware, cabinets, countertops and plumbing fixtures.
The parking requirement for a personal service establishment is one space per 200 square feet of gross floor area, bringing the required parking for this use to 13 spaces plus one accessible space. There are five regular and two accessible spaces in front of the building, and additional shared parking spaces north of the building, behind the building and along Town Center Lane. No trip generation analysis was required because of the similar traffic impact to the previous tenant.
Business Details:
The Medical Spa will have 8-10 employees, including medical doctors, nurse practitioners, reception/office management staff, medical assistants, and an esthetician. Proposed hours of operation are Monday - Saturday, 9 a.m. - 6 p.m. and will allow for walk-ins and scheduled appointments. There will be no overnight stays at the facility. A proposed list of services is included in the Applicant’s narrative (see Staff Attachment).
Land Use:
The subject property is zoned Town Center and designated Mixed Use (MU) on the city’s Future Land Use Plan (FLUP). Surrounding land use designations:
North: MU
South: MU
East: Parks and Open Space (Parks at Town Center)
West: MU
Summary:
Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the City Council shall consider the following factors:
1) The use is harmonious and compatible with surrounding existing uses or proposed uses;
2) The activities requested by the applicant are normally associated with the permitted uses in the base district;
3) The nature of the use is reasonable and appropriate in the immediate area;
4) Any negative impact on the surrounding area has been mitigated; and
5) That any additional conditions specified ensure that the intent of the district purposes are being upheld.
Citizen Input:
On April 11, 2024, the City mailed out nine letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site.
Staff has received no letters of support or opposition in response to this SUP request.
Planning and Zoning Commission Recommendation:
At the April 23, 2024 Planning and Zoning Commission meeting, Commissioners unanimously recommended approval of the SUP request as presented.
Alternatives:
The City Council has the following options when considering a Specific Use Permit:
§ Approve as submitted.
§ Approve with modified or additional condition(s).
§ Table the agenda item to a specific date with clarification of intent and purpose.
§ Deny.
