PUBLIC HEARING: Consider an ordinance approving amendments to the City of Keller Unified Development Code (UDC), adopted by Ordinance No. 1746 dated July 7, 2015, by amending Article Eight - Zoning Districts, Development Standards, Tree Preservation, Section 8.03 Zoning Districts, by defining the boundaries of the OTK - Old Town Keller District, and by replacing Figure 1 of this section with a new Old Town Keller Boundary Map, and; providing penalties; authorizing publication; and establishing an effective date. (UDC-22-0005)
Action Requested:
Conduct a public hearing and consider an ordinance approving amendments to the City of Keller Unified Development Code (UDC) by defining the boundaries of the Old Town Keller District, and by replacing Figure 1 of the UDC’s OTK section with a new Old Town Keller Boundary Map.
Background:
The Planning and Zoning Commission and City Council recently approved a Future Land Use Plan amendment from Mixed-Use (MU) to Retail/Commercial (RTC) and the zoning change from Old Town Keller (OTK) to Retail (R) for the properties between Bear Creek Parkway and the actual Bear Creek. During this process, staff realized that the OTK boundaries were defined in the UDC and accompanied by a map. The proposed amendments will align the boundary description and map with the recent FLUP amendment and zoning change in OTK.

Summary:
The proposed UDC Amendments include:
1. Revised OTK district boundary description that reflects the actual Bear Creek as the new southern boundary.
2. Updated OTK district map reflecting the zoning change.

Citizen Input:
An amendment to the text of the UDC requires a public hearing notice to be published in the local newspaper ten (10) days prior to the scheduled Planning and Zoning Commission meeting date and fifteen (15) days prior to the City Council Meeting Date. Notices were published in the July 17, 2022 and August 7, 2022 editions of the Fort Worth Star-Telegram for the respective Planning and Zoning Commission and City Council Public Hearings.
Planning and Zoning Commission Recommendation:
On July 26, 2022, the Commission unanimously voted to recommend approval of the UDC text amendment as presented.
Alternatives:
The City Council has the following options when considering a Specific Use Permit:
§ Approve as submitted.
§ Approve with modified or additional condition(s).
§ Table the agenda item to a specific date with clarification of intent and purpose.
§ Deny.
