Consider an ordinance amending the City of Keller Code of Ordinances by amending Chapter 2, Administration, by deleting Article IX, Reserved, and adding a new Article IX, “Capital Improvements Advisory Committee,” to establish the committee in accordance with Chapter 395 of the Texas Local Government Code; authorizing publication; and establishing an effective date.
Background:
Chapter 395 of the Texas Local Government Code, as amended by Senate Bill 1883 (effective September 1, 2025), requires municipalities that assess water, wastewater, or roadway impact fees to establish a Capital Improvements Advisory Committee (CIAC).
Recent legislative changes increased transparency, notice, and membership standards. Specifically, at least 50% of the CIAC must represent the real estate, development, or building industries, and meeting materials must be available to the public at least 60 days before notice of a public hearing on land use assumptions or impact fees. The law also establishes a three-year limitation on increasing impact fees and requires a two-thirds vote of the governing body to impose or amend such fees.
Creating this committee ensures Keller’s continued compliance with Chapter 395 and positions the City for future impact-fee program updates.
Council Action:
Staff recommends approval of the ordinance creating the Capital Improvements Advisory Committee (CIAC) to ensure continued compliance with Chapter 395 of the Texas Local Government Code, as amended by Senate Bill 1883.
