Action Requested:                     

Approve a resolution authorizing a Supplement to the Public Highway At-Grade Crossing Agreement with Union Pacific Railroad Company for the Keller Hicks Road Improvements Project, for the Public Works Department; and authorizing the City Manager to execute said supplement in an amount of $104,000.

 

Background:                     

The Keller Hicks Road Improvements Project is a joint project with the City of Fort Worth. The limits of the project are from Lauren Way in Fort Worth to just east of the railroad in Keller. This project includes the railroad crossing, which requires an agreement with Union Pacific Railroad Company. In May of 2023, the City entered into an agreement with the railroad based on estimated construction costs.

The construction of the railroad crossing is complete and Union Pacific Railroad has calculated to total actual cost of construction. The actual construction costs are $104,000 above the estimates provided in the original agreement.

The agreement stipulates that the City is responsible for overages incurred during construction. The final cost of the agreement will be $317,917.00.

 

Financial Impact:

Funding for this activity is included in the Street System Capital Improvements Project Fund with funding provided by the General Fund. If unforeseen circumstances are encountered, which results in an overage of the project budget, further council action and a budget amendment may be required.
