Background:

                     797 Keller Parkway is currently occupied by a Daily Stop Convenience Store and Shell Gas Station. The Applicant is now requesting an additional accessory use by proposing a U-Haul drop off location for this site. This request would be considered an Automobile Renting use as well as outside storage.

 

                     Under the Retail Zoning District, Automobile Rental uses require an SUP. Per the UDC, Automobile Rental is defined as the “renting of automobiles, motorcycles, and light load vehicles”.

 

                     Light Load Vehicles are defined as “A pickup truck having a manufacturer's Gross Vehicle Weight Rating (GVWR) of 14,000 pounds or less; or any other self-propelled vehicle having a manufacturer's Gross Vehicle Weight Rating (GVWR) of 11,000 pounds or less. Light Load Vehicle also includes any towed vehicle with a manufacturer's Maximum Loaded Trailer Weight (MLTW) of eleven thousand (11,000) pounds or less, and/or having no more than two axles, such as boat trailers, motorcycle trailers, utility trailers, and cargo trailers. A Light Load Vehicle may not have more than two axles. Light Load Vehicle includes Automobiles and Motorcycles, but not Recreational Vehicles or Agricultural Vehicles and Equipment.”

 

o                     Gross Vehicle Weight Rating is defined as, “The actual weight of a vehicle plus the manufacturer's maximum allowable weight of passengers, fluids, cargo, and optional equipment that may be carried by the vehicle.”

 

                     Considering this, the only U-Haul equipment that could meet this requirement would need to have a Gross Vehicle Weight Rating (GVWR) of 11,000 pounds or less. After researching the U-Haul fleet, the 26’, 20’, 17’, and 15’ moving trucks all exceed the 11,000 pound requirement. The only U-Haul vehicles that meet this requirement are the following:

o                      10’ moving truck.

o                      9’ cargo van.

o                      8’ pickup truck.

o                     4x8 & 5x8 cargo trailer.

o                     4x7 & 5x9 utility trailer.

                     The Applicant has agreed to limit the truck types to the list above that can be dropped off at this location via the U-Haul app & website.

                     This would also be considered outside storage: “the keeping, displaying, or storing, outside a building, of any goods, material, merchandise, or equipment on a lot or tract for more than 24 hours. No outside storage or display is permitted unless approved by a SUP in the Retail Zoning District.


SUP Requests:

1) The Specific Use Permit request to operate an Automobile Rental use in the Retail Zoning District.

2) The Specific Use Permit request to allow outside storage and display in the Retail Zoning district.

Economic Impact:

 

There are currently four ‘truck rental and moving equipment’ businesses currently operating in the City of Keller and many other options in the surrounding area (see chart below). This is not an industry that has been identified for active recruitment. Vehicle rentals do not bring significant sales tax revenues to the city (less than $500 YTD) and adding these services would not have a positive economic impact.

Summary:

Section 8.02 (F.2.a) of the UDC states that when considering a SUP request, the Planning and Zoning Commission and City Council shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

 

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

                     

 

Citizen Input:

On November 25, 2020, the City mailed out twenty two (22) letters of Notifications for a Public Hearing to property owners within three hundred feet (300’) of the subject property. Staff also posted a public hearing notice sign on the subject property.

                     

As of December 2, 2020, staff has received one email of opposition from the public regarding this SUP application. The Applicant provided 8 signatures of support from the surrounding area.

 

 

Alternatives:

The Planning and Zoning Commission has the following options when considering a Specific Use Permit:

 

-                     Recommend approval as submitted.

-                     Recommend approve with modified or additional condition(s).

-                     Table the agenda item to a specific date with clarification of intent and purpose.

-                     Recommend denial.

 

City Council Action:

If a recommendation is provided this item will go forward to City Council on January 5th, 2020.
