Action Requested:                     

Consider a resolution approving Dean Construction as the CMAR to manage the design cost in the amount of $15,000.00 for Preconstruction Services Fee, and 2.5% of the Guaranteed Maximum Price (GMP) for Construction Services Fee, and approve Dean Construction to manage construction of the improvements to the Keller Sports Park.

 

Background:                     

On October 4, 2022, City Council directed staff to pursue a CMAR to be brought forth for future City Council consideration for managing the construction of the improvements to the Keller Sports Park.

Staff advertised for a CMAR as part of a two-piece sealed Request for Qualifications (RFQ) process. Six companies responded and Dean Construction was unanimously chosen as being the most qualified among the three staff members assigned to the selection committee. As required by State bidding laws, once Dean was selected, their fee proposal was opened. The fees total $15,000.00 for Preconstruction Services Fee, and 2.5% of the GMP for Construction Services Fee. The dollar amount of the Construction Services Fee will be established as part of the GMP that will be determined when the design is finalized based upon complexity and timeline.

The project consists of: adding a new grass multi-purpose field with an associated parking lot; replacing one grass soccer field with synthetic turf; constructing two new lighted baseball fields; renovating existing multi-purpose and baseball fields; constructing new restrooms, storage and concession buildings; constructing a new field house and meeting rooms, renovating existing restroom/concession buildings; constructing new shade structures; and enhancing landscaping, lighting, fencing, backstops, and netting throughout the park.

A preliminary view of the park improvements is attached (see Exhibits B and C). It highlights progress made thus far through design reviews with staff and the architect. It must be emphasized that this is the point where Dean is deeply involved managing construction costs to meet or beat the final budgeted amounts.

Dean’s contract, (see Exhibit A) also includes a cost savings initiative stating that any savings below their budgeted amount has a shared savings formula of 75% to the City and 25% back to Dean.

Once the construction GMP is established at the end of the design phase; any further reduction below the GMP will have the same 75/25% savings share. Should the final pricing exceed the GMP, Dean is responsible for any overrun not approved by the City in advance.

 

Financial Impact:

The estimated cost of this project is $25,000,000.00 of which $2,332,300.00 was allocated for construction document, bidding and construction administration services, leaving $22,667,700.00 for CMAR and construction services.

Funding for the entire project will be paid from the Park System Capital Improvement Fund with funding from the Keller Development Corporation Obligation Bonds.

 

Citizen Input/Board Review:                     

A special Task Force was created by City Council in August of 2021. Members included representatives from all youth sports associations that utilize the Keller Sports Park, including the Keller Youth Association, Keller Soccer Association, Alliance Rugby Club, Keller Lacrosse Club and representatives from Keller Equestrian Clubs, along with members of the City Council and Parks and Recreation Advisory Committee. Multiple public task force meetings and presentations on the project were held between August 2021 and February 2022. In March 2022, City Council accepted the Task Force recommendation and instructed staff to begin the design process.

The City Attorney has been provided the proposed agreement.
