Action Requested:                     

Approve a resolution terminating the contract approved by Resolution No. 4442 on November 16, 2021 with A&B Construction, LLC of Dallas, Texas, and authorizing the City Manager to provide the seven (7) day written notice per sections 15.02.A.1 and 15.02.B of the contract documents.

 

Background:                     

On September 22, 2021 three (3) competitive sealed proposals were received for the Water System Capital Improvement Plan Phase 2 project. This project is also known as SWIFT Phase 2. Staff, with the assistance of an engineering consultant, reviewed the proposals and references and recommended A&B Construction, LLC of Dallas, Texas be awarded the contract. City Council approved the resolution on November 16, 2021.

The contractor has substantially completed four of the five locations included in this project. The four locations that were completed were seven months behind schedule.  Staff repeatedly requested schedule updates and information regarding how the project would be completed in a reasonable timeframe to no avail.  The lack of communication left staff with no choice but to recommend terminating the remaining contract. The location not completed with this project (Pate Orr water line) will be included in Phase 3, which is currently under design.
