Present and take action on a Petition For Referendum requiring that the City Council repeal Resolution No. 3909, and the vote of City Council approving a Chapter 380 Economic Development Program Agreement, pursuant to Chapter 380 of the Texas Local Government Code, and pursuant to the City’s Economic Development Policy, with The Birch Racquet and Lawn Club, or be submitted to the voters of this City for approval or disapproval.
Background:
A Petition for Referendum was filed with the City Secretary on August 24, 2017. The petition was verified and is to be presented to the City Council on September 5, 2017, in accordance with the Keller City Charter and Texas Election Code.
Sections 7.02 and 7.03 of the Keller City Charter provides that it is the duty of the City Council, within the fifteen (15) days after the receipt thereof, to pass and adopt such resolution that repeals the original, or to call a special election to be held on the next uniform election date
The City Council is to take action on either to repeal Resolution No. 3909, passed on July 25, 2017, approving the Chapter 380 Economic Development Agreement with The Birch Racquet and Tennis Club; or order an special election shall be held in the City of Keller, Texas on May 5, 2018, for the approval or disapproval of the passage of Resolution No. 3909 approving a Chapter 380 Economic Development Program Agreement with The Birch Racquet and Lawn Club.
