Consider a resolution approving an Interlocal Agreement with the Trinity River Authority of Texas to provide technical services for the City of Keller Wastewater Pretreatment Program, and authorizing the City Manager to execute said Agreement on behalf of the City of Keller.
Action Requested:
Consider a resolution authorizing the City Manager to execute an Interlocal Agreement with the Trinity River Authority of Texas (TRA) to provide technical services for Keller’s Wastewater Pretreatment Program and to maintain compliance with state and federal regulations.
Background:
The City of Keller Wastewater Pretreatment Program, established in 2003 by Ordinance 1142, sets requirements for Keller users of the wastewater treatment plant, maintained and operated by the TRA, and requires Keller to comply with all applicable state and federal laws, including the Clean Water Act and the General Pretreatment Regulations (40 CFR 403).
The Interlocal Agreement will allow the TRA to assist Keller with the implementation of the new effluent regulation enacted by the US Environmental Protection Agency (EPA) on reduction of discharges containing mercury from dental offices into the wastewater treatment plant. The Dental Office Point Source Category rule was effective July 14, 2017 and is codified at 40 CFR part 441. The implementation of pretreatment standards will only be applied to new source dental dischargers at this time. Procedures for existing dental dischargers will be addressed in the future.
Additionally, the TRA will provide technical assistance as needed to be in conformity with the City of Keller Ordinance 1142, including inspection, classification, and analytical services.
The proposed Interlocal Agreement is effective from October 1, 2017 through September 30, 2018.
Budget Impact:
Funding is available in the Fiscal Year 2017-18 Utility Services Admin Fund budget.
Financial Considerations:
The total costs charged by the TRA shall not exceed $2,500 annually.
Legal Review:
The Interlocal Agreement has been reviewed by the City Attorney.
