Consider a resolution rejecting the bid from North Texas Contracting for the construction of the Mount Gilead Road Shared Use Path, and authorizing the City Manager to rebid the project on behalf of the City of Keller, Texas.

Action Requested:                     

Reject the bid from North Texas Contracting previously awarded on October 17, 2017. TxDot has approved the rebidding of the construction for Mt. Gilead trail.

 

Background:                     

The Mt. Gilead Trail project is a federally funded Safe Routes to Schools project administered by TxDOT. One of their requirements for approval to proceed with construction is that the project must be advertised in the City’s newspaper of record.

The ads were sent to the Fort Worth Star-Telegram to be posted on three specific dates. Six bids were received and grouped fairly close together with the low bidder meeting specifications and within budget. A recommendation for award was forwarded to, and approved by, the City Council on October 17, 2017.

As is normal practice, an affidavit from the newspaper was requested by the City but after several requests they disclosed they had neglected to run the ads. Since several bids were received there was no indication this newspaper oversight had occurred. Further research revealed that the bids received were a result of plan house subscriptions and our website. Therefore, even though sufficient bids were received, the City has been directed by TxDOT to reject all bids and begin the advertising and bidding process again.

Since the project is federally funded we have no choice but to comply and staff is taking the necessary steps to expedite the process as much as possible. This is expected to delay the project approximately 6 weeks.
