Consider a resolution approving a first amendment to the interlocal agreement for combined municipal court services for the cities of Colleyville and Keller; and providing an effective date.
Action Requested:
Consider a resolution to amendment to the Combined Municipal Court Interlocal Agreement with the City of Colleville to extend the Interlocal Agreement thru September 30, 2023.
Background:
In 2012, the Cities of Keller and Colleyville entered into an interlocal agreement for a combined regional municipal court with end term date of September 30, 2018. Per the agreement, Colleyville hosts the municipal court for both cities. The municipal court costs are divided by a three year average of citations, and Keller funds an administrative fee since Colleyville manages and hosts the court. For FY 2018-19, Keller will fund 57.1% of the court costs and Colleyville will fund 42.9%. The proposed resolution would allow the current interlocal agreement to continue for an additional five years through September 30, 2023.
The 82nd Legislature of the State of Texas passed House Bill 984 and was signed into law on May 19, 2011, an act relating to agreements between neighboring municipalities regarding jurisdiction of cases in municipal courts. This act allowed for the creation of the Regional Municipal Court. This Regional Court is the first of its kind in Texas.
The City of Colleyville is also considering an amendment to the Interlocal Agreement of the Combined Municipal Court at their July 17, 2018 Council meeting.
Financial Impact:
The FY 2018-19 proposed Municipal Court costs are $465,619 and the Keller portion of the costs are $265,875. In addition, Keller will fund an administrative fee of $45,725 for total Municipal Court costs of $311,600. Without the interlocal agreement, Keller would have to fund full Municipal Court costs which increase the Municipal Court costs by approximately $154,019.
