Consider a resolution authorizing the use of the Competitive Sealed Proposal method for the Water System Capital Improvements - Phase 1 project (Project No. 601704) as the best value project delivery method for the City of Keller, and delegating authority to the City Manager or his designee, and establishing the limits of that authority as allowed by Texas Government Code Chapter 2269, Subchapter D, to implement the Competitive Sealed Proposal Method for the City of Keller, Texas.
Background:
Texas Government Code Chapter 2269 allows construction projects to be delivered in a method other than the Competitive Bidding method, more commonly known as design-bid-build. However, the municipality must formally state what method provides the best value prior to advertising. Subchapter B allows City Council to delegate authority to the City Manager, or his designee, to implement the Competitive Sealed Proposal method.
The Water System Capital Improvements Plan is a significant city-wide project which is funded by the Texas Water Development Board (TWDB) State Water Implementation Plan for Texas (SWIFT) low interest loan program. Phase 1 of this project includes the replacement of water distribution systems in seven (7) locations of the City using traditional open trench and trenchless technology construction methods, including horizontal directional drilling and pipe bursting. It is crucial to evaluate the proposals for construction services based on price, experience, qualifications and other weighted criteria to obtain the best value for Keller which is accomplished by using the Competitive Sealed Proposal method.
The proposed resolution states the Competitive Sealed Proposal method as providing the best value for the project and delegates the authority needed to implement this alternative delivery method without further action of the City Council, except that execution of the final contract for construction will require the subsequent approval of the City Council.

The costs for project delivery are included in the project budget.
