Title

Consider acceptance of a Local Option Election Petition for the purpose of allowing the legal sale of all alcoholic beverages including mixed beverages.

Body

Background:

On March 18, 2019 the City Secretary issued a petition for the “The legal sale of all alcoholic beverages including mixed beverages” upon receipt of an Application for a Petition for a Local Option Election.

The petitioners had 60 days to receive 7,411 signatures which equals 35% of the registered voters who voted in the most recent gubernatorial election.

The petition was returned to the City with 8,771 signatures.  The signatures were verified by Tarrant County Elections Administration.  7,847 signatures were accepted as registered voters in the City of Keller.

Per Section 501.032 of the Election Code, the petition must be considered at the next regular City Council meeting on or after the 30th day after the petition has been filed with the City Secretary’s Office.

Per Section 501.033 of the Election Code, the date the petition is presented and the names of the signers must be recorded in the minutes of the City Council.

Attached is the letter from Tarrant County Elections Administration declaring the petition valid and the list of individuals who signed the petition.  There were 192 signatures that were not in Tarrant County Elections Administration’s database, therefore the signer name could not be determined and they are not included on the attached list.

Staff recommends acceptance of the Local Option Election Petition.
