Background:

On August 12, 2019, the Planning and Zoning Commission recommended approval of the changes resolving and clarifying easement maintenance requirements, specifically related to tree preservation and tree planting.

During this meeting, Staff did not include Article 8 in the notification to the public. Because of this oversight, Staff is bringing forward the following standard to be added in the UDC, ‘location of trees and shrubs further than five feet from utility lines shall remain and/or comply with UDC landscaping requirements,’ which will be located in Section 8.03 - Town Center Zoning District.

 

Citizen Input:

An amendment to the text of the UDC requires a public hearing notice to be published in the local newspaper ten (10) days prior to the scheduled Planning and Zoning Commission meeting date and fifteen (15) days prior to the City Council Meeting Date.

 

The notice for the Planning and Zoning Commission public hearing was published in the

August 30, 2019, edition of the Fort Worth Star-Telegram. 

 

The notice for the City Council public hearing was published in the

September 1, 2019, edition of the Fort Worth Star-Telegram. 

 

As of September 5, 2019, Staff has not received any responses from the public on this UDC text amendment request.

 

Alternatives:

Planning and Zoning Commission has the following options when considering an amendment to the text of the UDC:

 

-                     Recommend approval as submitted.

-                     Recommend approval with modifications or additional amendments(s).

-                     Table the agenda item to a specific date with clarification of intent and purpose.

-                     Recommend denial.

                     

City Council Action:

If the Planning and Zoning Commission takes action and makes a recommendation on this agenda item, then this UDC Text Amendment application will be scheduled for City Council action on September 17, 2019.
