Consider a resolution approving a Local On-System Agreement with the Texas Department of Transportation for improvements to U.S. Highway 377 at Bates Street and authorizing the City Manager to execute all documents related thereto on behalf of the City of Keller, Texas.

Action Requested:                     

The Texas Department of Transportation (TxDOT) requires municipalities to enter into an agreement for improvements to a TxDOT facility that will be undertaken by those municipalities.  This Local On-System Agreement (LOSA) specifies the roles and responsibilities of each entity, the associated costs and timeframes.

 

Background:                     

This project will add a median to U.S. Highway 377 and a pedestrian hybrid beacon to improve pedestrian access across US Highway 377 plus reconstruction of Bates Street.  The design is complete and easement acquisition along Bates Street is underway.  TxDOT requires this LOSA to grant permission for construction within their right of way.  Construction is required to start within six months of the executed LOSA and the city will be responsible for all maintenance.  The bidding process will begin once the executed LOSA is received from TxDOT.

 

Financial Impact:

A project budget of $3,800,000 is included in the approved FY2020-21 CIP budget.

 

Citizen Input/Board Review:                     

The staff Task Force and consultant team overseeing the Old Town Keller Phase II project have hosted several public input sessions since starting the conceptual layout development in 2018, along with numerous one-on-one conversations and meetings with OTK property owners. The most recent public meetings included the Mayor’s Spotlight session on OTK in July 2021 and the Neighborhood Meeting in November 2020.

 

Legal Review:                       

The City Attorney has reviewed and approved the proposed agreement.
