Background:

The Applicant requests a Specific Use Permit (SUP) to open a new and used goods retail shop in the Old Town Keller (OTK) zoning district. An SUP is required to sell used goods in the OTK zoning district.

 

The Applicant and his wife aim to offer “distinctive, high-quality, new and upcycled fashion items that narrate a compelling story,” while being conscientious of the environment and encouraging customers to live a more sustainable life.

 

Items for sale will be sourced from artists, designers, thrift stores, estate sales, auctions, and donations.

 

Site Design:

The Applicant will take over a portion of the building at 138 Olive Street, most recently occupied by a retail shop, Donna’s Gift Closet.                      

 

Hours of Operation:

Monday: 10 a.m. to 7 p.m.

Wednesday through Friday: 10 a.m. to 7 p.m.

Saturday: 10 a.m. to 5 p.m.

Sunday: Noon to 3 p.m.

 

Trip Generation:

Because the last tenant of this space was also retail sales, a Trip Generation Form was not required as part of this application.

 

Summary:

Section 8.02 (F)(2) of the UDC states that when considering a SUP request, the City Council shall consider the following factors:

 

1)                     The use is harmonious and compatible with surrounding existing uses or proposed uses;

 

2)                     The activities requested by the applicant are normally associated with the permitted uses in the base district;

 

3)                     The nature of the use is reasonable and appropriate in the immediate area;

 

4)                     Any negative impact on the surrounding area has been mitigated; and

                     

5)                     That any additional conditions specified ensure that the intent of the district purposes are being upheld.

                     

 

Citizen Input:

On February 29, the City mailed out 24 letters of notification for this Public Hearing to all property owners within three-hundred feet (300’) of the subject site. A public hearing notice sign was posted on the site.

 

To date, staff has not received any written support or opposition to this request. The Applicant provided signatures of individuals with whom he discussed the proposed business model. An online petition was also provided. 

 

Planning and Zoning Commission Recommendation:

At the March 12, 2024 Planning and Zoning Commission meeting, Commissioners unanimously recommended approval of the SUP request as presented.

 

Alternatives:

The City Council the following options when considering a Specific Use Permit:

 

§                     Approve as submitted.

§                     Approve with modified or additional condition(s).

§                     Table the agenda item to a specific date with clarification of intent and purpose.

§                     Deny.
