Action Requested:                     

Approve a resolution authorizing the use of the Competitive Sealed Proposal method for the South Elm Street Reconstruction project and delegating authority to the City Manager and/or his designee to implement the Competitive Sealed Proposal method.

 

Background:                     

Texas Government Code Chapter 2269 allows construction projects to be delivered in a method other than the Competitive Bidding method, more commonly known as design-bid-build.   However, the municipality must formally state what method provides the best value prior to advertising.  Subchapter B allows City Council to delegate authority to the City Manager, or his designee, to implement the Competitive Sealed Proposal method.

South Elm Street is the next project in the on-going improvements to Old Town Keller.  Design is nearing completion and the bidding process is expected to start this spring.  It is crucial to evaluate the proposals for construction services based on price, experience, qualifications and other weighted criteria to obtain the best value for Keller, which is accomplished by using the Competitive Sealed Proposal method.

The proposed resolution states the Competitive Sealed Proposal method as providing the best value for the project and delegates the authority needed to implement this alternative delivery method without further action of the City Council, except that execution of the final contract for construction will require subsequent approval of the City Council

 

Financial Impact:

Funding is available for this project in the Street System Capital Improvement Project Fund with funding provided by the General Fund, Keller Development Corporation, and debt funding. As unforeseen circumstances are encountered, which results in an overage of the project budget, further council action and budget amendments may be required.
